How to request public information, how long the answer takes and what to do if refused.
Dreptul dumneavoastră
Orice persoană are dreptul să solicite și să obțină de la autoritățile și instituțiile publice informațiile de interes public. Accesul este gratuit; se pot percepe doar costurile efective ale serviciilor de copiere (Legea nr. 544/2001).
Termenele de răspuns
- 10 zile — termenul obișnuit de răspuns;
- 30 de zile — dacă informația necesită o documentare mai amplă; în acest caz sunteți înștiințat despre prelungire în termen de 10 zile;
- 5 zile — termenul în care vi se comunică refuzul, motivat în scris;
- 24 de ore — pentru informațiile solicitate de mass-media.
Dacă vi se refuză
Puteți depune reclamație administrativă la conducătorul instituției, în termen de 30 de zile de la luarea la cunoștință a refuzului. Răspunsul se comunică în 15 zile de la înregistrare.
Dacă nici acest răspuns nu vă mulțumește, vă puteți adresa secției de contencios administrativ a tribunalului, în termen de 30 de zile de la expirarea termenelor de mai sus. Acțiunea este scutită de taxă de timbru.
